Petty Theft

Theft, or larceny, is the taking and carrying away of the tangible property of another, by means of trespass or fraud, with the intent to permanently deprive the owner of that property. Identity theft is similar to petty theft, however, the cases tend to be much more complicated and can have federal implications.

Embezzlement is similar to larceny in that it is the fraudulent conversion of the personal property of another by a person in lawful possession of that property. Embezzlement is the primary charge in many white collar prosecutions.

Petty theft is known as a “wobbler” and can be charged as either a misdemeanor or a felony, depending on the value of the item taken, and whether the accused has any prior convictions for petty theft.
