Three Strikes

The three strikes laws in California mandate that a person convicted of three or more “serious” or “violent” felonies must be imprisoned for 25 years to life. Which felonies are “serious” or “violent” are set out in California statute. These crimes include, but are not limited to, rape, kidnapping, 1st degree burglary, murder, crimes that result in great bodily injury to a victim, gang crimes and assault with a deadly weapon.  Moreover, if you have a prior "strike" and are accused of a new felony which is not "serious" or "violent", you are subject to greatly increased terms of incarceration and in-custody credit limitations.

In any case involving a felony, your attorney needs to be looking ahead to ensure that “priorable” or valid strikes are avoided at all costs.
